FedEx Seeks Tariff Refunds After Court Ruling on Presidential Powers

FedEx has filed a lawsuit seeking refunds for tariffs it paid under emergency trade powers that were later ruled to have exceeded presidential authority.

The global shipping company FedEx has taken legal action against the administration of Donald Trump, demanding a full refund of tariffs imposed under the International Emergency Economic Powers Act. The move follows a recent decision by the Supreme Court, which found that the use of the law to apply broad tariffs went beyond the president’s legal authority.

According to court filings, FedEx said it imported goods from countries affected by the tariffs and paid duties while the policy was in force. The company argues that these payments caused financial harm and should now be returned. The case was lodged with U.S. Customs authorities in the Court of International Trade.

FedEx operates one of the world’s largest logistics networks, handling millions of packages daily across numerous countries. Company executives have previously warned that tariffs were putting pressure on earnings, with estimates suggesting a significant impact during the 2026 fiscal year. They also highlighted difficulties faced by customers, particularly small exporters, during the period when the duties applied.

The lawsuit is among the first by a major corporation seeking refunds after the court ruling, though several other companies have already challenged the tariffs in similar cases. The outcome could influence how future trade measures are enforced and whether businesses can recover costs linked to policies later deemed unlawful.
